CAW Local 385 is being taken to Judicial Review

Local 385 is being taken to Ontario Superior court under the judicial review process by a former temporary worker. The worker is appealing a decision of the Ontario Labour Relations Board which stated that he did not receive proper representation from our Local Union. This is known as a failure to represent, a violation of the Labour Relations Act, section 74. The Labour Board found that his claims were unfounded. This worker then tried to have the Ontario Ombudsman charge our Union. This too failed. It was after this attempt at taking our Local to court that he filed the application for judicial review. Senior legal Counsel for the CAW will be representing the Local Union. It should be noted that very, very few applications for Judicial Review are ever overturned. The case will be heard sometime in October or November of 2004.
